Madison Communications has filed a second writ petition in the Delhi High Court, according to media reports, contesting the constitutional validity of certain provisions of the Competition Act and several clauses in the recently notified CCI General Regulations, 2024.
In its latest petition, Madison has questioned the vires of Section 26(1) of the Competition Act, which permits the Competition Commission of India (CCI) to direct an investigation by the Director General (DG) after forming a prima facie view.
The agency has argued that the Competition Act does not provide the CCI with disciplinary control over advocates and that the contested provisions infringe the right to counsel and affect procedural fairness.
The matter is expected to be heard next on 8 January 2026.
Previously, the Delhi High Court issued directions in Madison Communications’ earlier writ petition against the CCI, restraining the regulator from taking further steps against the agency or its senior leadership until the next hearing.
